Terms of Service

Poker Motion Studio is operated by:

Poker Motion Studio is a browser-based video editor for creating broadcast-style poker graphics.

You enter information about a poker hand, such as:

• players;
• hole cards;
• stacks;
• blinds;
• betting actions; and
• board cards.

The service generates animated graphics such as event bars, board-and-pot panels, player rows, action callouts, and winner banners. You can place those graphics on a timeline over your own video and export a finished MP4.

Your video is processed on your own device. It is not uploaded to Poker Motion Studio.

You must be at least 18 years old to use Poker Motion Studio.

By using the service, you represent that you are at least 18.

You may need an account to access some features.

You are responsible for:

• providing accurate account information;
• keeping your login credentials secure; and
• activity occurring through your account, except to the extent caused by our own failure to secure the service.

Do not share your account credentials in a way that gives unauthorized people access to your account.

Poker Motion Studio currently offers four plans.

Prices are in US dollars and exclude applicable taxes.

Monthly and annual subscriptions are billed in advance through Stripe.

Subscriptions automatically renew until cancelled.

If you cancel a subscription, your paid plan continues through the end of the period you have already paid for.

Cancellation does not create a right to a refund for the unused portion of that period. See section 22.

The standard Lifetime price is $849.

A founders discount currently makes the Lifetime plan available for $599. The discount ends at October 1, 2026 at 12:00 AM, which means the last full day to purchase at the founders price is September 30, 2026.

After the founders discount ends, the standard Lifetime price will apply unless another offer is published.

People who join the Poker Motion Studio waitlist before launch are promised $5 for their first month on a monthly Standard or Pro plan.

The offer is:

• limited to one use per person;
• valid only for the first month;
• available only on a monthly Standard or Pro plan;
• not available for annual plans;
• not available for the Lifetime plan; and
• followed by the normal subscription price after the discounted first month.

The offer cannot be combined with another discount unless we expressly say otherwise.

Prices do not include applicable taxes.

You are responsible for taxes that apply to your purchase except taxes that we are legally required to collect from you.

You retain ownership of the content you create or provide through Poker Motion Studio.

We do not claim ownership of your videos, project content, poker-hand information, player-library information, or exported work.

You are responsible for your content.

10.1 Your video rights

You must have the rights necessary to use the video footage you import into Poker Motion Studio. This includes any rights required to edit, reproduce, publish, distribute, display, or otherwise use the footage.

10.2 People appearing in your footage

If your footage shows identifiable people, you are responsible for obtaining whatever consent, permission, release, or other legal authorization is required for your intended use. This includes, where applicable:

• their likeness;
• their name;
• their appearance;
• their poker play;
• their hole cards;
• their winnings or losses; and
• disclosure of other information about their participation in the game.

This is particularly important for footage of private or home poker games. Poker Motion Studio cannot police these rights because your footage never reaches our servers.

10.3 No official-broadcast misrepresentation

You must not falsely represent your video or graphics as an official broadcast, official production, or authorized publication of a poker event, venue, league, tournament, club, broadcaster, or other organization when you are not authorized to make that representation.

10.4 Your responsibility for published content

You are responsible for the videos and other material you create, export, publish, sell, or distribute using the service.

You may sell videos you create with Poker Motion Studio. That is expressly permitted and is part of the intended use of the service.

We need a limited licence to handle content that you choose to store with us.

You grant us a non-exclusive, worldwide licence to host, store, reproduce, and display your content only as reasonably necessary to:

• provide the service to you;
• provide cloud synchronization you request;
• display your content back to you; and
• operate, maintain, secure, and technically administer the service.

This licence ends when you delete the applicable content, subject to any limited period during which deletion from backups or systems is technically necessary or legally required.

We do not use your customer content in marketing without asking you first. We do not use customer content to train machine-learning models.

Your video footage remains on your device.

The service reads your video through your browser. Editing and export happen on your machine. We do not upload your video footage to our servers.

This means that we cannot inspect your footage to determine whether you have the necessary rights or permissions. You remain responsible for those matters.

Paid plans may allow you to synchronize project documents to our servers.

Cloud-synced project documents contain project information such as hand data, timeline information, settings, and other JSON project data.

Cloud sync does not upload your underlying video footage.

The number of cloud-synced projects depends on your plan.

You must keep your own backups of anything you care about.

Local projects can exist only in your browser.

If you clear browser data, use private browsing, switch devices, change browsers, or otherwise lose local browser storage, the project may be permanently lost.

Because we do not receive local projects or video footage, we may have no copy from which to restore them.

You should export project files and maintain your own backups. Cloud synchronization is not a substitute for maintaining backups of your important work.

You may use Poker Motion Studio only for lawful purposes.

You must not:

• use the service for illegal activity;
• harass, threaten, or impersonate another person;
• infringe another person’s intellectual-property, privacy, publicity, or other rights;
• falsely represent your work as an official broadcast or authorized production;
• attack, probe, disrupt, overload, or interfere with the service;
• attempt to gain unauthorized access to the service or another user’s account;
• circumvent technical restrictions or plan limits;
• use the service to bypass watermarks or other restrictions applicable to your plan;
• reverse engineer or attempt to extract protected parts of the service except where applicable law expressly permits it;
• resell or sublicense access to the Poker Motion Studio service itself; or
• help another person circumvent these restrictions.

You may sell, license, publish, and distribute the videos you create with the service.

Commercial use is permitted on Standard, Pro, and Lifetime plans.

The Free plan is not licensed for commercial use.

Commercial use of your finished videos does not give you permission to use footage, names, likenesses, logos, trademarks, or other material that you do not have the right to use.

Poker Motion Studio uses third-party providers including:

• Supabase for authentication, database services, and player-photo storage;
• Stripe for payment processing and subscription billing; and
• Vercel for hosting and content delivery.

Your use of third-party services may also be subject to their own terms and policies.

Payments and subscription billing are handled by Stripe.

Poker Motion Studio does not receive or store your card number on its own servers or in its database.

Poker Motion Studio is provided on a best-effort basis.

We do not promise that the service will:

• always be available;
• always work without interruption;
• be free from bugs;
• be compatible with every browser or device; or
• remain unchanged.

Because the application performs important processing on your own device, performance can also depend on your browser, hardware, operating system, available storage, and other factors outside our control.

We may change, improve, replace, or discontinue features.

We will not knowingly describe a planned feature as though it were currently available.

Poker Motion Studio may develop additional features in the future.

A planned feature is not part of the service merely because it is mentioned in a roadmap, marketing material, or other communication.

In particular, cloud rendering is not currently available. If cloud rendering is introduced in the future, the intended feature is to render the graphics as a transparent overlay file without uploading or rendering the customer’s underlying video footage.

The introduction of any future feature may be subject to additional terms or an updated version of these Terms.

No refunds or returns are permitted whatsoever. All sales are final.

This includes monthly subscription fees, annual plan fees, and the one-time Lifetime payment. It includes unused time, partial periods, and periods remaining after you cancel.

If there is some other circumstance where you believe you deserve a refund, please reach out at support@pokermotion.studio and we will do our best to help you.

Nothing in this section removes or limits any refund, cancellation, or consumer right that applicable law does not allow us to exclude. Where such a right applies to you, it continues to apply regardless of this section.

Poker Motion Studio itself, including its software, interface, design system, branding, templates, graphics systems, and other service components, is owned by or licensed to us.

These Terms do not transfer ownership of the service to you.

Your right to use Poker Motion Studio is limited to the rights expressly granted by these Terms and your applicable plan.

You may stop using Poker Motion Studio at any time.

You may cancel a paid subscription as described in these Terms.

You may also close your account, subject to any applicable account-closure process.

Closing your account does not automatically delete projects that exist only on your own device. Those projects are under your control, not ours.

We may suspend or terminate your access if:

• you materially breach these Terms;
• you use the service unlawfully;
• you attack or compromise the service;
• you attempt to circumvent plan restrictions;
• your use creates a material security or legal risk; or
• we are otherwise legally required to do so.

Where reasonably possible, we will give you notice and an opportunity to address the problem before termination, unless immediate action is reasonably necessary.

When your account or subscription ends, your right to use paid features ends when the applicable paid period ends, unless we state otherwise.

Termination does not transfer ownership of your content to us.

Content stored on your own device remains yours.

Because we do not have copies of local projects or video footage, closing your account does not cause us to delete those local files from your device.

Cloud-synced content is handled according to our Privacy Policy and applicable retention practices.

You agree to defend, indemnify, and hold harmless “PokerMotion.Studio” and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising out of or relating to:

• your video footage;
• your published or distributed content;
• your failure to obtain rights or permissions required for your footage;
• claims concerning a person’s likeness, name, privacy, publicity rights, or disclosure of their poker play;
• your infringement of another person’s intellectual-property or other rights;
• your unlawful use of the service;
• your violation of these Terms; or
• your misrepresentation that content is an official or authorized broadcast.

This indemnity is intended to cover claims arising from content that you create, publish, or distribute using Poker Motion Studio.

To the maximum extent permitted by law, Poker Motion Studio is provided on an “as available” and “as is” basis.

We disclaim warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will always be available, uninterrupted, error-free, secure, or compatible with every device or browser.

We do not guarantee that an export will meet your particular technical, broadcast, platform, or commercial requirements.

Nothing in these Terms excludes a warranty or consumer protection right that cannot legally be excluded.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service or these Terms will not exceed the fees you paid to us for the service during the 12 months immediately before the event giving rise to the claim.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or loss of data.

These limitations do not apply to liability that cannot legally be limited or excluded.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit us to limit.

Nothing in these Terms is intended to take away rights that you have under mandatory consumer-protection laws.

If the law of your country, state, or other jurisdiction gives you rights that cannot legally be waived, those rights continue to apply.

These Terms are governed by the laws of New York, United States, without regard to conflict-of-law rules, except where mandatory law provides otherwise.

Disputes must be resolved in New York State.

We reserve the right to make any and all changes to these Terms at any time.

We may update these Terms when the service, business, or applicable legal requirements change.

If we make a material change, we will provide notice where required by law. The updated Terms will state their effective date.

Your continued use of the service after the effective date of updated Terms means you accept the updated Terms, to the extent permitted by law.

You may not transfer or assign your account or rights under these Terms without our consent, except where applicable law permits such transfer.

We may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.

If a provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.

These Terms and any documents expressly incorporated into them constitute the agreement between you and Poker Motion Studio concerning your use of the service.

If there is a conflict between these Terms and a specific written agreement signed by you and us, the signed agreement controls to the extent of the conflict.
